 The emancipation proclamation specifically permit  that all people in need as slaves in rebellious areas are and on ward free .

That was when President Abraham Lincoln issued the Initial Emancipation Proclamation that provided for the emancipation of slaves in those states or parts of those states still in rebellion with effect from January 1, 1863
